Successfully Settled an HRTO Claim: Protecting Our Client’s Rights

At Apuntar Legal Services, we are committed to standing up for employees who face unfair treatment in the workplace. We are pleased to share a recent success where we helped a client resolve a Human Rights Tribunal of Ontario (HRTO) claim.


Our client was terminated from her employment in under two years and was offered only four weeks’ pay in lieu of notice. While this slightly exceeded the minimum Employment Standards Act (ESA) requirement of two weeks, our client believed her termination was not solely based on length of service—it was a reprisal linked to her previous gender-based complaints.


Before filing a formal claim, we attempted to negotiate directly with the employer, seeking a fair resolution. Unfortunately, the employer refused to engage in meaningful discussions, leaving us no choice but to proceed with filing a claim at the HRTO.


During the mandatory mediation, we successfully negotiated a settlement, and our client received approximately $15,000. This outcome not only provided fair compensation for our client but also reinforced the principle that employees are protected from retaliation for raising human rights concerns in the workplace.
